Promotion Period

The Payactiv It’s About Time Documentary Promotion (the “Promotion”) begins on or about 9:00:01 a.m. Eastern Time (“ET”) on Wednesday, June 26, 2019 and ends at 11:59:59 p.m. PT on Wednesday, July 31, 2019. Participants can enter the promotion during the promotion period. The Promotion is sponsored by Payactiv, 4300 Stevens Creek Blvd., San Jose, CA 95129 (the “Sponsor”). The Promotion benefits Payactiv Foundation, Inc., (the non-profit “Partner”). The official clock for purposes of the Promotion is the computer of the Sponsor.

How to Donate

If your social media account is set to “protected mode,” or “private” your entry may not be visible and thus may not be received by Sponsor. Your social media account used for entry must be set to “public”.

No purchase necessary to participate. An individual will be deemed a participant if they share the documentary or post a link to it on social media via one of the following four methods :

1. Linked In Entry: Go to the Payactiv Linked In page at http://www.linkedin.com/company/payactiv-inc- and share the IT’S ABOUT TIME documentary video post from their page;
2. Facebook Entry: Go to the Payactiv Facebook page at https://www.facebook.com/payactiv/ and share the IT’S ABOUT TIME documentary video post from their page;
3. Twitter Entry: Share the IT’S ABOUT TIME documentary video link and use the hashtag #EarnedWageAccess and tag @Payactiv in the Twitter post.
4. Website Entry: Go to ItsAboutTimeTheFilm.com and use the share feature of the video to their social media channel(s).

For every eligible photo or video shared, Payactiv will donate $5 (up to $100,000), to the non-profit Partner. The donation will be paid to the Partner by December 31, 2019, and used for providing financial wellness to low-income workers under duress.

Sponsor reserves the right to suspend, cancel or modify the Promotion at any time.

Eligibility

All photos and videos must include the information requested by the sponsor to be eligible. Submissions made by (including, but not limited to) commercial sweepstakes/contest subscription notification and/or entering service sites, will be declared invalid and disqualified for this Promotion. The use of automated entry devices is prohibited, and no mechanically reproduced submissions are allowed; all such submissions are void. A submission must not violate the rights of any other party, including but not limited to intellectual property rights or rights of privacy/publicity. Submissions may not contain, as determined by the Sponsor, in its sole discretion, any:

1. sexually explicit or suggestive content; violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
2. illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); political agenda or message;
3. is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submission;
4. language that defames, misrepresents or contains disparaging remarks about other people or companies;
5. messages or images inconsistent with the positive images and/or good will to which the Sponsor wishes to associate;
6. copyrighted materials owned by others will not be eligible;
7. violates any law.

By sharing an eligible submission, you represent and agree that your submission will not infringe upon the intellectual property rights of any third party.

Photo Rights and Requirements

Participants agree that each photo or video submission becomes the property of the Sponsor and all submissions and all information contained therein, may be used in Payactiv’s marketing efforts to promote this or future promotions or for purposes of advertising.

Limitation of Liability

ENTRANTS RELEASE, DISCHARGE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS, SPONSOR AND ITS RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS AND REPRESENTATIVES (THE “RELEASED PARTIES”) FROM AND AGAINST ANY LIABILITY FOR ANY DAMAGES, INJURY OR LOSSES (INCLUDING DEATH) TO ANY PERSON, OR PROPERTY, OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY FROM ACCEPTANCE, POSSESSION, MISUSE OR USE OF ANY PRIZE OR PARTICIPATION IN ANY SWEEPSTAKES RELATED ACTIVITY OR PARTICIPATION IN ANY PROMOTION CONDUCTED BY SPONSOR.

General Conditions

Illegible, unintelligible or incomplete submissions will be disqualified. The Released Parties are not responsible for any lost, late, misdirected, stolen or undelivered entries. The Released Parties are not responsible for technical, network, electronic, computer, hardware or software failures of any kind, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any materials related to any Promotion. The Released Parties are not responsible for incomplete, garbled or delayed Internet/e-mail computer entries or for any malfunction or technical errors occurring on any Social Media Website on which a Promotion is conducted.

This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook or Instagram. You are providing your information to Sponsor and not to Facebook or Instagram. The information you provide will only be used for the purpose set forth in the Official Rules.
